Justice Department Speaks up on Online Gambling
December 27, 2011
We have reported on some pretty heavy moves made by the American Government with regards to online casinos and online gambling in recent weeks. So it is quite a surprise to be able to bring you some good news (from a legal point of view) for a change.
The US Department of Justice (DOJ) has decided to make its position on online gambling and online casinos more clear. The US Wire Act of 1961 is the major backbone of gambling legislation which applies to online casinos and out of state gambling. Following a legal decision made by the DOJ back in September, two US States, Illinois and New York, came forward to ask the DOJ for further clarification over certain points of the Wire Act. As a result of this, the DOJ was forced to entirely reverse its stance on online gambling within several States of America. Easing off on online gambling legislation and opening the door for a more diverse and totally legal form of online gambling in these states.
This new gambling legislation situation will be of extreme interest to online poker players in the USA. Recently all of the major online poker sites were forced to withdraw from the US, following legal proceedings being taken against them for a variety of reasons. However, it seems that the door is now open to allow inter-state and out of state gambling providers to operate in the USA, but only in some states.
nfortunately, the situation is still rather gray, and it is unclear just how wide ranging this newly changed set of legislation is. Whilst it may be likely that online pokers sites and online casinos in general may now face an easier time of operating within the USA, the situation is far from clear.
We are sure that in the coming months, the US Government will have to make a hard and fast ruling upon the legality of online poker and online casinos within America. Until the Department of Justice made this change in policy, it was looking as if online gambling would become a thing of the past in the USA. The future now looks a lot more interesting. Let’s hope the US Government sees sense and continues to work with online casinos towards making them legal in the USA.
